I have a 2010 D22 STR without an exhaust and with a chip, my temps have never been abnormal and the performace boost is HUGE. I do plan to get an exhaust eventually but I don't think it's completely necessary unless you are tuning the hell out of the chip.
Ive not had any problems with my makita, but Milwaukee and DeWalt both make very solid drills, make sure you get a metal chuck. From my experience the Milwaukee batteries seem to die very quickly compared to Makitas and Dewalts. Just my two cents.
If I was you I would test drive another 2012 navara at the dealership you bought it from and see if the other one does it too, if not then demand a replacement!
